ZR Original: CMU English Department Continues it War on Student Dissident

Peter KoperPeter Koper is the latest English Professor at Central Michigan University to join the war against Dennis Lennox.  Lennox has weathered a near physical assault on his camera by Dean of Students Pamela Gates, who happens also to be an English Professor, a blistering set of e-mails by English professors and graduate assistants that Outside Lansing first broke in October which internal sources relayed to us, and now a formal complaint for distributing literature by yet another English Professor that threatens to have Lennox expelled.

This time, Lennox forwarded us the documents he obtained when he did his Family Educational Rights and Privacy Act (FERPA) required review of documents relating to charges against him.  Those charges will be heard by administrators next week.

The documents are astonishing.

First, Koper's complaint is dated on October 23, 2007, the same day as the event, and refers internally to events that happened "last night, Tuesday, October 23".  Of course, that is impossible.  While it could be mere human error - dating irregularities in documents, or small inconsistencies of any kind, are one of many signs of tampering or later than actual creation of the document.  In this case, it wasn't until late November - the day the ACLU sent CMU a letter admonishing it on its videotaping policy, that CMU filed a student code of conduct proceeding against Lennox for this matter.  What is else is odd?  In excessive zeal, he carbon copies CMU's presidente, Dean Gates, and three other top CMU officials.  If this is just a minor complaint against an unknown student, why carbon those folks?  Why Gates?  Why Rao?  One might speculate that the whole letter was a fabrication intended for that audience - particularly given Gates connection (as an English Professor) to Professor Koper and the English Department's proven anti-pathy to Dennis Lennox.  

In addition to the not so English-aware mis-spelling of Dick Cheney's name (sic: Chaney), Koper proves himself to be a real zealot [ed note: at a reader's request, we've changed the less precise word "noid" to a word with more meaning and less personalization, nonetheless, we stand behind our belief the letters have an over-zealous and authoritarian element to them] - I dare say fascist - in his letter. In his zeal to cure CMU of what he considers litter, he writes, "This morning I again consulted the Policies on Advocacy Activities to confrim my judgment that the young man had violated them. [ed note: who made him the judge, something he takes on the role of as twice] I ask that you investigate this matter and bring appropriate charges against this young man."  He noted he didn't have a name, but was certain he could identify him if he saw him.  And so he did - when Voisin sent a single picture to him at 10:20 am on October 25.  Now, if I recall my Law & Order episodes, there is a reason a line-up has multiple pictures in rather than one.  You don't want to lead the witness. Even paper line-ups use the technique of multiple similar pictures to ensure fairness.  If this were a real court with real due process, the case would be tossed on that ground alone.

And why do I mention 10:20 am on October 25?  The letter was erroneously dated October 23, but must have been sent and must have been delivered in person on October 24 because it referred to events on October 23.  That's an awfully quick investigation - and that is all there was in the file.

No questions to Mr. Koper by the investigator to corroborate details of the letter. No specific followups about facts.  Just a quick judgment made in the same morning the investigation began - and ended there.  And THEN IT TOOK A MONTH TO FILE CHARGES ON THIS?  If it were this simple, and the violation significant, why not file immiediately.  Instead, Voisin waits until the day the ACLU files a complaint with CMU on its videotaping ban which wasn't really a ban.

In addition, Koper comes off as pretty weak.  "His behavior in taking the fliers from my hand was coercive. [Koper, are you really an English professor?  Look up the meaning of the word] I did not feel I could continue my activity in his presence." If Koper were really an authority figure and identified himself, then he completely lacked in courage in running from Lennox in such a cowardly way.  If Lennox were genuinely a threat, Koper should have called the police.  This lends credence to Lennox's version of the story that a man was taking his fliers, the man refused to identify himself so Lennox also refused to identify himself.  In all you have a 40-something man cowering from a barely 20-something student.

Finally, don't take CMU at its word if you're considering using the "Ombudsman".  Ombudsman are supposed to represent the consumer or in this case student (who is a consumer) in matters dealing with the university.  Most universities and many other institutions utilize them.  Here's CMU's promise to students:

The Student Ombuds Office is part of the President's Office and a place for student voices to be heard. You can expect:
* Accessibility
* Confidentiality
* Impartiality

CMU's ombudsman is Susan Rademacher.  So much for confidentiality - when asked by Anthony Voisin if Lennox had contacted her and spoke with her about certain matters, she told him.  That's par for the course - Lennox' privacy rights have been squatted on so many times its not even news anymore.

You can email Susan Rademacher at ombuds@cmich.edu and complain.  Don't count on it being confidential though.

Lennox will have a student code hearing later this month.  Contact CMU and tell them to drop their anti-First Amendment hearings against Lennox.

What a joke.  Republicans never want to hold their own accountable, like President Bush, VP Cheney or the Bush Cronies that have ruined our government.

You're wrong.  You're rhetoric is laughable when compared to the facts. I actually want to eliminate corrupt Republicans more than Democrats because I know it makes us stronger.

Simply put  -  both parties are made of human beings, subject to temptation.  Both parties have corrupt members.  And all corrupt officials should be held to the same standard.

Bill Clinton - committed perjury.  Nothing happened.  Newt and other Congressmen at the time withdrew as Speaker of the House for personal affairs (no perjury).  

Democratic Louisiana Congressman has $90,000 in his freezer. Pelosi does nothing to his committee standing.  Republican Senator in Idaho resigns because he was caught in conflicting stories and plead guilty to solicitation for sex in a bathroom stall.  

And I'm not saying the R's should have escaped the consequences.  We take care of our own - can you say the same, Bruce?

Answer me that, Chet.  And are you out there urging Pelosi to put impeachment back on the table or holding Mike Bishop accountable for the tax mess?  No.

All Republican seem to talk about is how their taxes are too high and their "pro-life" agenda.  They have no ideas on how to solve problems.  They don't take global warming seriously.  They certainly didn't hold their colleagues accountable when they were in power.  

Chet you can't be serious saying Republicans take care of their own.  Bush's term is the most corrupt in memory and there have been no consequences.  In fact, the one guy that was held accountable and Bush commuted his sentence and Bush is still hiding evidence and e-mails.

First, where did I say I agreed with everything put out by, or even like, the Bush administration? You can bet Republicans hold him responsible for his spending - why do think we talk of a return to Reagan principles. If Bush was a great president, all the R candidates would be talking of modeling Bush principles.

Second, there is a difference between honest disagreement on issues and corrupt activity.  You don't impeach someone for disagreeing with you on issues.  You disagree with Republicans on taxes and some Republicans on their "pro-life" agenda.  That doesn't make either you or those you disagree with corrupt.

What specific criminal or corrupt activity would you impeach Bush on?  Not your mere disagreement with his executive decision on the war - what has he done that violated his oath of office, duty, or law?

In 2006, Republicans were in majority.  Tom Delay was forced to not run again, that Florida guy who internet messaged with an intern (no crime proven, but definitely impropriety) was quickly forced to immediately resign ... those things don't happen without pressure from both inside and outside the party.  Your guys got cash in their freezers and you don't put any pressure on them.

And you can bet that I'm going to be using the Republican primary to hold some local candidates accountable.  That's the main place for accountability holding, and that's where I focus my energies - at least until the primary is over.

There is along list of treasonous and high crimes committed by the Bush adminstration.  The Valerie Plame outing would be first on my list.  Especially when Plame was out only CIA operative working on intelligence regarding Iran's WMD program, or lack thereof, as concluded in the NIE from over a year ago.  Spying on Americans without warrants would be another impeachable offense.  Lying about the reasons for going to war would be another.  All you have to do is read the drafted Articles of Impeachment by Robert Wexler or Dennis Kucinich.  Over one-third of members on the Judiciary committee are now in favor of impeachment.  All we need now is Nancy Pelosi on our side.  

The Republicans could have held Bush accountable for his ruinous tax policies and our war policies, but the Republicans have blocked all attempts to hold the Bush regime accountable, so you can't talk to me about Republicans holding politicians accountable.  

Foley's dalliances with male pages was common knowledge for over a year and nothing was done by the Republicans Congress.  

Republican accountability is an oxymoron.

First,  you're using a guilt by association and strawman fallacy.  You argue that one failure of ethics by a Republican and even a failure by others to notice implies that all other Republicans would find that ethical lapse acceptable.  And you've built a strawman - basically, if people disagree with you on really tough and complex policy issues they are supporting unethical policy.

Bruce, most of your stuff is speculation, and not internally consistent.  Foley - if Foley's conversations were "common knowledge" - how did the media not get it earlier.  It defies credulity to believe anyone of such a common knowledge pool wouldn't publish the story to advance their career.  Therefore, its more likely only a tiny number, if any, people knew about it.  Once public - Foley was forced out.

But the facts betray.

You call certain policies "ruinous".  You're entitled to that opinion.  But its policy disagreement - not impeachable material.  You make general allegations about "spying on Americans without warrants", "lying" about the war, etc. that ordinarily require specificity - that is, events, with proof.  The "spying" is obviously a variation of the Patriot Act issues - a law which raises concerns even for Republicans (you don't notice that many of us are watching it closely because you are blinded by partisanship) - but a law which was passed by huge majorities of both parties.  If you want to impeach literally everybody in Congress and remove them with Bush, fine.  The fact that Pelosi doesn't agree with you, and only a third of the Judiciary cmt favor impeachment (a handful of individuals who are the naturally inclined to appeal to the hardest left "base" like yourself because the districts they represent are not competitive), suggests impeachment should not occur.  I'll hand it to folks like Hillary and Pelosi - once you're in power you behave somewhat more responsibly to preserve it and your rhetoric fades.  As to the war, there is no question there were huge intelligence failures, poor early management, and I believe overall failures of strategy in the choice to go to war.  Proving an impeachable offense requires proving the President knew the intelligence was untrue or faulty and proceeded anyway.  There is a huge contradiction on the left, and in your arguments though - on one hand, you accuse Bush of being the dumbest president of all-time, and on the other you accuse of being a mastermind liar requiring intelligence of the highest order. Which is it?

The simple fact is governments' are inefficient and badly manage almost everything they do, including war.  The good news is that our inept government is less inept than most of our enemies, and that we have an open system (which exposes failure and makes future failures harder).  World War II (and every war) was full of FUBAR'd moves by the military, and even FDR himself (like the great debate over the cause of Pearl Harbor, and even whether it was intentionally allowed to happen).  Does that mean that we should have impeached FDR?  No. No hard evidence of pre-knowledge exists.
